| Resumo / Abstract | A presente dissertação teve como objetivo geral identificar os deveres jurídicos decorrentes do telediagnóstico em uma relação médico-paciente intermediada por sistemas de Inteligência Artificial (IA). Para alcançar tal finalidade, os objetivos específicos buscaram contextualizar o desenvolvimento da Sociedade da Informação e o surgimento da IA explorando seus conceitos, origem, regulamentação no Brasil e as bases dos sistemas algorítmicos. Posteriormente, discorreu-se sobre a relação médico-paciente, seus aspectos conceituais e históricos, a implementação de sistemas de IA na saúde e as modalidades da telemedicina. Em seguida, definiu-se o telediagnóstico, destacando suas particularidades em relação ao diagnóstico tradicional, os deveres jurídicos emergentes dessa modalidade e a responsabilização jurídica por falhas em sistemas de IA no suporte ao diagnóstico. O problema de pesquisa central investigou quais deveres jurídicos emergem do telediagnóstico em uma relação médico-paciente mediada por sistemas de IA. A pesquisa adotou o método de abordagem dedutivo, partindo de premissas gerais para alcançar uma conclusão particular, e a vertente qualitativa, com procedimento monográfico e técnica de revisão bibliográfica, abrangendo diversas fontes documentais para oferecer uma perspectiva renovada sobre o tema. A presente pesquisa alinha-se à área de concentração “Direitos Humanos e Sociedade” e se relaciona com a linha de pesquisa “Direitos Humanos, Cidadania e Novos Direitos”. Dentre os resultados, observou-se que o avanço tecnológico, especialmente a integração da IA e da telemedicina no setor da saúde, redefiniu a interação médico-paciente, demandando a identificação de novos deveres jurídicos e critérios de responsabilização. A discussão sobre a relação médico-paciente evoluiu de um modelo paternalista para um vínculo de confiança e autonomia do paciente, sendo o telediagnóstico uma modalidade que insere uma interação triangular entre médico, paciente e sistema de IA. Por fim, concluiu-se que o telediagnóstico impõe deveres específicos aos profissionais de saúde e entidades envolvidas, dada a complexidade e inovação, sendo fundamental delinear esses deveres e a responsabilização em casos de falha do sistema de IA para garantir a segurança e confiança no processo de cuidado à saúde. O trabalho forneceu parâmetros para a construção de um marco regulatório para as complexidades relacionadas a esse tipo de atendimento. | pt |
| Resumo / Abstract | This dissertation aimed, in general, to identify the legal duties arising from telediagnosis in a doctor–patient relationship mediated by Artificial Intelligence (AI) systems. To achieve this purpose, the specific objectives sought to contextualize the development of the Information Society and the emergence of AI by exploring its concepts, origins, regulation in Brazil, and the foundations of algorithmic systems. Subsequently, the dissertation discussed the doctor–patient relationship, its conceptual and historical aspects, the implementation of AI systems in healthcare, and the modalities of telemedicine. Next, telediagnosis was defined, highlighting its particularities in relation to traditional diagnosis, the legal duties emerging from this modality, and legal liability for failures in AI systems that support diagnosis. The central research question investigated which legal duties arise from telediagnosis in a doctor–patient relationship mediated by AI systems. The research adopted a deductive approach, moving from general premises to a particular conclusion, and a qualitative orientation, with a monographic procedure and bibliographic review technique, encompassing diverse documentary sources to offer a renewed perspective on the topic. This research is aligned with the area of concentration “Human Rights and Society” and is related to the line of research “Human Rights, Citizenship and New Rights”. Among the results, it was observed that technological advancement, especially the integration of AI and telemedicine into the health sector, has redefined the doctor–patient interaction, demanding the identification of new legal duties and criteria for liability. The discussion about the doctor–patient relationship has evolved from a paternalistic model to a bond of trust and patient autonomy, with telediagnosis representing a modality that introduces a triangular interaction among doctor, patient, and AI system. Finally, it was concluded that tele-diagnosis imposes specific duties on health professionals and involved entities, given its complexity and novelty, making it essential to delineate those duties and liability in cases of AI system failure to ensure safety and trust in the healthcare process. The work provided parameters for constructing a regulatory framework for the complexities related to this type of care. | en |
