A presente dissertação analisa a regulamentação jurídica do comando único da política pública de assistência social e seus impactos na gestão municipal do Sistema Único de Assistência Social (SUAS), tomando como recorte empírico os municípios da Encosta Superior do Nordeste do Estado do Rio Grande do Sul (AMESNE), no período de 2015 a 2025. Parte-se do reconhecimento de que, embora a assistência social tenha sido reconhecida como direito de cidadania e dever do Estado a partir da Constituição Federal de 1988, sua materialização permanece tensionada por desigualdades federativas, fragilidades institucionais e práticas de gestão nem sempre alinhadas às diretrizes normativas do SUAS. O problema de pesquisa consiste em compreender de que forma o comando único, enquanto princípio organizador da política de assistência social, tem sido juridicamente regulamentado e efetivado nas gestões municipais, bem como quais os impactos dessa regulamentação na organização, coordenação e efetividade da política nos territórios analisados. Parte-se da hipótese de que, apesar da robustez do arcabouço jurídico-normativo, a implementação do comando único ocorre de forma heterogênea, revelando avanços formais, mas também a persistência de limites estruturais, especialmente em municípios de pequeno porte, relacionados à insuficiência de gestão interfederativa, à fragmentação administrativa e às capacidades estatais desiguais. O estudo tem como objetivo investigar os impactos da regulamentação jurídica do comando único nas gestões municipais da assistência social, à luz das diretrizes da Lei Orgânica da Assistência Social (LOAS), da Política Nacional de Assistência Social e do SUAS. Para tanto, analisa-se a construção histórica da assistência social no Brasil, desde suas raízes assistencialistas até sua consolidação como direito social; examinam-se os fundamentos normativos e institucionais da política pública de assistência social; investigam-se as diretrizes, os instrumentos e os mecanismos de regulação do SUAS, destacando o pacto de aprimoramento da gestão e a institucionalização do comando único; e analisa-se empiricamente a dinâmica do comando único nas gestões municipais da assistência social, considerando o perfil institucional dos municípios, a utilização dos instrumentos de gestão, os efeitos da regulamentação jurídica nas práticas administrativas e os desafios enfrentados nos territórios pesquisados. A pesquisa adota abordagem qualitativa, com método dedutivo e procedimentos histórico e monográfico, utilizando técnicas de pesquisa bibliográfica e documental, a partir da análise de literaturas específicas da área, obras multidisciplinares, legislações e normativas federais, estaduais e municipais, documentos institucionais, bem como dados secundários extraídos de bases oficiais disponibilizadas em sites institucionais governamentais. A pesquisa vincula-se à área de concentração Direitos Humanos e Sociedade e à linha de pesquisa Direito, Sociedade e Estado, que tem como objetivo a análise de políticas públicas em sua relação com o Estado e a sociedade, orientada à promoção da transformação social, à garantia de direitos e ao reconhecimento do valor intrínseco da vida humana.
This dissertation analyzes the legal regulation of the unified command principle in public social assistance policy and its impacts on the municipal management of the Unified Social Assistance System (SUAS), taking as an empirical focus the municipalities of the Upper Northeast Slope of the State of Rio Grande do Sul (AMESNE), from 2015 to 2025. It begins with the recognition that, although social assistance has been recognized as a right of citizenship and a duty of the State since the 1988 Federal Constitution, its implementation remains strained by federal inequalities, institutional weaknesses, and management practices not always aligned with the normative guidelines of SUAS. The research problem consists of understanding how the unified command principle, as an organizing principle of social assistance policy, has been legally regulated and implemented in municipal administrations, as well as the impacts of this regulation on the organization, coordination, and effectiveness of the policy in the analyzed territories. This study hypothesizes that, despite the robustness of the legal and regulatory framework, the implementation of the unified command system occurs heterogeneously, revealing formal advances but also the persistence of structural limitations, especially in small municipalities, related to insufficient inter-federative management, administrative fragmentation, and unequal state capacities. The study aims to investigate the impacts of the legal regulation of the unified command system on municipal social assistance management, in light of the guidelines of the Organic Law of Social Assistance (LOAS), the National Social Assistance Policy, and the Unified Social Assistance System (SUAS). To this end, it analyzes the historical construction of social assistance in Brazil, from its welfare roots to its consolidation as a social right; examines the normative and institutional foundations of the public policy of social assistance; and investigates the guidelines, instruments, and regulatory mechanisms of the SUAS, highlighting the pact for improving management and the institutionalization of the unified command system. This study empirically analyzes the dynamics of single command in municipal social assistance management, considering the institutional profile of the municipalities, the use of management instruments, the effects of legal regulation on administrative practices, and the challenges faced in the researched territories. The research adopts a qualitative approach, with a deductive method and historical and monographic procedures, using bibliographic and documentary research techniques, based on the analysis of specific literature in the field, multidisciplinary works, federal, state, and municipal legislation and regulations, institutional documents, as well as secondary data extracted from official databases available on governmental institutional websites. The research is linked to the area of concentration Human Rights and Society and the research line Law, Society and State, which aims to analyze public policies in their relationship with the State and society, oriented towards promoting social transformation, guaranteeing rights, and recognizing the intrinsic value of human life.
