Título: Os principais direitos violados pelas mudanças climáticas: uma abordagem à luz dos direitos humanos

Descrição: Dissertação apresentada ao Programa de Pós-Graduação em Ciências Ambientais da Universidade do Extremo Sul Catarinense - UNESC, como requisito parcial para a obtenção do título de Mestre em Ciências Ambientais.
Resumo: As mudanças climáticas constituem-se atualmente em uma importante pauta da agenda internacional. Isso se deve ao fato, de que, cada vez mais o mundo vem sofrendo com os impactos dessas mudanças. Os danos provenientes dessas mudanças acabam permeando os direitos fundamentais e violando os Direitos Humanos, trazendo sérios problemas socioambientais e socioeconômicos. Este estudo teve por objetivo geral identificar os principais dispositivos violados da Declaração Universal dos Direitos Humanos decorrentes dessas mudanças. Constituiu como objetivos específicos identificar os principais bens jurídicos lesados pelas mudanças climáticas; correlacionar as violações aos Direitos Humanos com os direitos Constitucionais, analisar a importância dos fóruns de mudanças climáticas para com a promoção dos direito humanos e por fim, propor alternativas voltadas à mitigação das mudanças climáticas. Para a realização deste estudo foram utilizados os métodos qualitativo e quantitativo, valendo-se da investigação e análise documental (Declaração Universal dos Direitos Humanos), bem como pesquisa bibliográfica obtida junto a jornais, revistas, artigos científicos, livros, e a participação em um fórum específico sobre mudanças climáticas. O núcleo central da pesquisa consistiu em responder a seguinte pergunta: Quais os principais dispositivos da Declaração Universal dos Direitos Humanos são comumente violados diante das mudanças climáticas? Conclui-se com a pesquisa que as mudanças climáticas afetam diretamente o homem, comprometendo diversos bens jurídicos, dentre eles a vida, a privacidade, a liberdade, a propriedade, o trabalho, o lazer, a saúde, e a educação, sendo esses os principais direitos humanos violados diretamente. Diante das inúmeras violações, ressalta-se a importância dos Fóruns de Mudanças Climáticas, a fim de promover diante do debate interno e externo, medidas voltadas para a prevenção, mitigação e adaptação às mudanças climáticas capazes de proteger os direitos humanos de forma plena e justa. Dentre as instituições nacionais com atribuições para atuar na observância das leis no país, a Polícia Federal possui competência constitucional capaz de fazer a persecução criminal dos crimes ambientais que violem os direitos humanos dos quais o Brasil seja parte, com base no §5° do art. 109 da Constituição Federal, podendo também diante da Emenda Constitucional 45/2004, o Ministério Público Federal assegurar o cumprimento das obrigações decorrentes de tratados firmados no que diz respeito aos direitos humanos, e suscitar deslocamento de competência para a Justiça Federal em qualquer fase do inquérito ou processo.
Climate changes currently constitute an important ruling in the international agenda. This is due to the fact, that the world is suffering with the impacts of these changes more and more. The damages caused by these changes end up permeating the fundamental rights and violating the human rights, bringing serious social, environmental and socioeconomic issues. The overall objective of this survey was to identify the main provisions violated in the Universal Declaration of Human Rights due to these changes. Identifying the main legal properties harmed by the climate changes became the specific aim; correlate the human rights violations with the Constitutional rights, analyze the importance of climate change forums for the promotion of human rights and finally, propose an alternative aimed at mitigating climate change. In order to go ahead with this survey, qualitative and quantitative methods were used considering the investigation and documental analysis (Universal Declaration of Human Rights) as well as bibliographic research from newspapers, magazines, scientific articles, books and the participation in a specific forum about climate changes. The core of the research consisted on answering the following question: What are the main provisions of the Universal Declaration of Human Rights commonly violated considering the climate change? We conclude with the research that the climate changes directly affect man, committing various legal rights, among them life, privacy, liberty, property, work, leisure, health, and education, which are the main human rights directly violated. Facing the numerous violations, the importance of the Climate Change Forum is emphasized in order to promote before the internal and external debate, measures focused on prevention, mitigation and adaptation to climate change able to protect human rights fully and fairly. Among the national institutions which has attribution to ensure compliance with the laws in the country, the Federal Police has constitutional authority able to make the criminal prosecution of environmental crimes that violate human rights to which Brazil is a party, based on §5 of the art. 109 of the Federal Constitution. By the Constitutional Amendment 45/2004, he public prosecutor can also ensure compliance with the obligations arisen from treaties concerning the human rights and making competence shift to the Federal Court at any stage of the investigation or proceedings.
